AGC, BIAW file suit over building-code appointments The state’s two largest construction-trade associations -- AGC of Washington and the Building Industry Association of Washington (BIAW) -- and have filed a lawsuit to hold the governor accountable for not following the law in making his most recent appointments to the State Building Code Council (SBCC) The groups allege Gov. Jay Inslee illegally appointed two individuals to fill vacancies on the council specifically reserved for nominees provided by the residential and commercial construction industries... Read more.

Contractor succeeds at Supreme Court against public owner in AGC-backed case (Lindsay Watkins, Ahlers
Cressman & Sleight, and Chair of AGC’s Legal Affairs Committee) A contractor won a rare but much-deserved victory at the Supreme Court on July 8, 2021 in Conway Construction Co. v. City of Puyallup, 197 Wn.2d 825, 490 P.2d 221 (2021). The case, which involved an aggressive stance by a public owner:
- confirmed that the public owner bears the burden of demonstrating a termination for default is justified,
- reaffirmed the requirement to provide an opportunity to cure, and
- rejected the public owner’s attempts to escape its own contract language that the contractor relied upon.

Legally dubious “labor neutrality” initiative creates complications for contractors (Nick Morton, Sebris Busto James) People First Bellingham, a coalition of political and social organizations, submitted petitions for four proposed initiative bills in July 2021. The third proposal, “Labor Neutrality,” would prohibit any person who receives city funds from using those funds to discourage unionization efforts. This initiative will be on the ballot when Bellingham residents cast their votes on November 2, 2021. The ordinance contains both restrictions on how city funds may be spent, as well as affirmative requirements as to
how recipients of city funds must segregate such funds... Read more.

AGC urges changes to long-term care program; taxes begin Jan. 1 AGC and a broad coalition of business and labor groups are calling on the Governor and legislative leaders to address concerns with the Long-Term Services and Supports Trust (LTSST). As discussed in previous AGC WORKS articles, the Legislature established the LTSST program in 2019. The program provides a maximum of $36,500 in lifetime benefits for eligible beneficiaries to apply to the cost of their long-term care. The LTSS Trust Program is funded through a 0.58 percent premium assessment on an employee’s wages. The premium assessment begins Jan. 1, 2022, and eligible beneficiaries may begin receiving benefits on Jan. 1, 2025. Those subject to the tax can opt-out if they have or purchase an as-good-or-better private long-term care plan by Nov 1.
