OSHA withdraws vaccine mandateOn January 25, the U.S. Occupational Health and Safety Administration (OSHA) revoked its COVID-19 vaccination-or-testing emergency temporary standard (ETS) applicable to private businesses with 100 or more employees, in light of the recent U.S. Supreme Court decision. According to Denise Gold, Corporate and Labor Senior Council, the agency will no longer pursue a permanent infectious-disease standard broadly applicable to private businesses, ending the threat of such a mandate enduring forever. A clear victory for AGC's advocacy efforts, Ms. Gold goes on to report the U.S. Supreme Court agreed with AGC’s argument, among others, that OSHA overreached and
exceeded its authority under the law. This is welcome news and brings some hope of easing construction labor
challenges as the industry struggles to reach pre-pandemic job levels.

Attention, DOD contractors: CMMC officially suspendedOn January 26, AGC received official notice that the initial phased rollout of CMMC, including use of DFARS clause 252.204-7021, Cybersecurity Maturity Model Certification Requirements, is suspended until further notice. However, the requirement for contracting
officers to verify that a current NIST SP 800-171 DoD Assessment is posted for solicitations that require implementation of NIST SP 800-171 security requirements will remain in effect. Further guidance indicates that DoD intends to implement "CMMC 2.0" with an updated program structure and requirements once the rulemaking process is completed. Sound Transit Best-Practices Committee: Call for applicationsThe AGC Sound Transit Best-Practices Committee is currently seeking applications for two available positions. Committee members are appointed by the AGC
officers to represent AGC as we advocate for continual improvement in construction contracting and share best practices with Sound Transit's construction department and executives. The Committee meets quarterly and develops sub-committees as needed. Applicants must be AGC members. Interested individuals can email Sonja Forster for application criteria. The application deadline is Wednesday, Feb. 2.

Port of Seattle implements contractor vaccine mandateEffective March 9, 2022, the Port of Seattle will require contractors and consultants working in most non-public Port facilities to be fully vaccinated against COVID-19. This requirement will apply
to all contractor/consultant employees if they enter the listed Port offices spaces to perform work, and their presence is more than fleeting. Even if a substantial portion of their work is performed outside of the identified Port offices. Bell Harbor International Conference Center.
