AGC asks Supreme Court to review state court decision on union destruction of property
(AGC of America) AGC of America and five other employer groups jointly submitted an amicus brief at the U.S. Supreme Court on June 15 in support of a request for review of a Washington Supreme Court decision that prevents a company from recovering damages from a union that sanctioned destruction of company property.
The issue in the case, Glacier Northwest, Inc. v. International Brotherhood of Teamsters Local Union No. 174, is whether the National Labor Relations Act (NLRA) preempts an employer’s state tort claim against a union for intentionally destroying the employer’s property in the course of a labor dispute.
The case arose in the context of collective bargaining negotiations between ready-mix concrete supplier Glacier Northwest and the union that represents its truck driver employees, Teamsters Local 174. The union called a work stoppage one morning just after the mixing trucks were fully loaded for the day and being dispatched for delivery to customers’ construction sites. Ample evidence shows that the union strategically timed the stoppage to cause damage to the trucks and to destroy the material by making it impossible to deliver the concrete before it hardened. AGC’s BUILD PAC's 2022 primary-election endorsements

There are several races in this primary election which AGC’s BUILD PAC Senior Council have identified as high priorities, including the 10th (Skagit/Island counties), 28th (Lakewood area), 42nd (Bellingham/Whatcom County area) and 47th (Kent area) districts. The candidate’s name on our endorsement page is a link to their website where you can learn more about them and how contribute to their campaign.
The maximum contribution for a legislative race is $1,000 for each the primary and general election.
Primary-election ballots began arriving in the mail on July 15. It's important for these candidates to have a strong showing in the primary election as it will help their success in the general. Another reason to vote early is that the earlier you vote, the earlier you get taken off the lists for robo-calls and political mail.

Read AGC’s lips: No new taxes
(AGC of America) AGC helped bring together nearly 200 organizations to oppose efforts to increase taxes on small, individually, and family-owned construction businesses amid record-setting levels of inflation.
On July 11, AGC helped lead an effort joined by 192 trade associations outlining opposition to two tax increases that, if enacted, would adversely impact small, individually, and family-owned construction businesses. On July 14, Senator Joe Manchin (D-W.Va.) agreed with AGC, at least for now.
In recent weeks, media reports indicated that, in order to resurrect the previously moribund Build Back Better Act, Senate Democrats were considering two tax proposals that would fall entirely on “pass-through” businesses whose owners are taxed on their individual, rather than corporate, tax return. One proposal would expand the so-called “net investment income tax,” which is a 3.8 percent tax on investment income—such as capital gains, dividends, rents, royalties, and the like—to apply to pass-through businesses where the owners actively participate in the business. This would result in an 11% tax increase on these businesses during a potential economic downturn, unprecedented supply-chain challenges, 40-year high inflation and a chronic labor shortage. Congressman Larsen tours AGC-member project in Bellingham
Congressman Rick Larsen joined members from WSDOT, AGC of Washington and AGC of America staff in a tour of Granite Construction’s Padden Creek fish-passage project in south Bellingham on July 11. The $25M project replaces current salmon barriers across SR11, I-5 and 33rd Street to allow upstream spawning in Padden Creek. This project is great example of a key focus for Washington State, as it is improving the highway and culvert systems along with increased environmental stewardship in the restoration of salmon habitat.
The job started back up recently for its second season. Last year, during the first season, a new culvert and stream enhancements were built across SR11 and two new bridges were built on I-5. The second season will finish the walls below I-5, build the stream under I-5, build the new arched culvert across 33rd Street and perform all of the landscaping/roadway finishes.
This project tour also provided AGC an opportunity to discuss with Rep. Larsen key issues facing our industry, such as supply-chain disruptions, construction workforce, opposition to mandatory PLAs and updates to Davis-Bacon requirements. It was a very interesting project to tour and some very productive conversations were held as well with Rep. Larsen.
Developers submit plans to remake
historic waterfront building

AGC members Faber Construction and Hartcourt submit proposal plans to Port of Bellingham for potential redevelopment on former Georgia Pacific plant site on the Bellingham waterfront
(Cascadia Daily News) A soccer stadium. An upscale convention center. A new home for Whatcom Family YMCA, or a new hotel called Titanic.
Four developers — Harcourt Developments from Ireland and three local groups — have submitted proposals to the Port of Bellingham that would transform the defunct Boardmill building into a major attraction for Bellingham’s waterfront.
Port officials asked prospective developers earlier this year to come up with a concept for the Boardmill that included a hotel and convention center, recognizing Bellingham’s need for a larger meeting space that would attract out-of-town groups. But the Port also left the door open for alternative ideas. Read more…
OSHA launches national emphasis program on outdoor, indoor heat hazards
(Construction Executive) The safety world has been abuzz about the creation of a specific standard to protect workers from the hazards associated with extreme heat. On October 27, 2021, the Occupational Safety and Health Administration (OSHA) published an Advance Notice of Proposed Rulemaking (ANPRM) titled Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings.
This ANPRM kicks off the process of rulemaking to establish a specific standard on protecting employees from heat exposure. Most believe the impending standard will closely follow the Regional Emphasis Program of Region VI (Arkansas, Louisiana, New Mexico, Oklahoma and Texas) that has been in place for more than 20 years. The Value of Drones
(Constructor Magazine) As increasing numbers of contractors try unmanned aerial vehicles, they are finding more and more ways drones can help them avoid delays, rework, safety issues and increased costs.
"Drone technology has proven time and time again to be valuable assets for project teams," says Erik Gronneberg, an assistant project manager and drone pilot with Columbia in North Reading, Massachusetts, an AGC of Massachusetts member. "It’s able to identify issues early before they become big problems, saving both time and money."
During the COVID-19 pandemic, Columbia used its drone photos to help with communication regarding project progress, saving architects and owners travel time. Read more…
